Using Evolución Educación

Who can use our services?

In general, every person over 18 years old, who agrees to the terms and conditions, can use the services provided on the EVOLUCIÓN EDUCACIÓN platform; however, CONMEBOL can at any moment and without prior notice restrict certain content. CONMEBOL reserves the right of admission, and the right to cancel subscriptions. The creation of your personal Evolución account entails the obligation to comply with any arising obligations, and the provided information is taken as an affidavit.

Our License

Subjected to the terms and conditions, and every regulation (including the Acceptable Use Policy, Honor System, and the course specific qualification requirements and other terms, detailed at the end of this document), EVOLUCIÓN EDUCACIÓN will grant you a limited, non-exclusive, personal, non-transferable and revocable license to use our services. The content is for personal use only, and it cannot, by any means, be used for commercial purposes. Username and password are very personal, and any activity carried out on the account will be the user's liability, whose acceptance implies the prohibition to share it with anyone. The user agrees and acknowledges the ownership of all intellectual property rights that belong exclusively to EVOLUCIÓN EDUCACIÓN.

Our Courses

Course Modifications

EVOLUCIÓN EDUCACIÓN reserves the right to cancel, interrupt or reschedule any course or modify its content, or the numerical value or importance of any task, questionnaire, or evaluation method. The courses offered are subjected to the Waiver and Limitation of Liability sections detailed below.

University Credits

As a general rule, the EVOLUCIÓN EDUCACIÓN courses do not grant university credits. However, EVOLUCIÓN EDUCACIÓN can conclude agreements to grant credits, which will be expressly indicated, mentioning the Institution to which they belong. It is herewith stated that granting credits for an institution does not imply accepting other institutions.

Warnings about the relationship between Students and Third-Party Institutions

In no case should participation in any of the EVOLUCIÓN EDUCACIÓN courses imply:

(a) a relationship between the participant and the educational institution EVOLUCIÓN EDUCACIÓN is partnered with;

(b) that registration to the platform acknowledges the student’s rights, tuition or similar in the educational institutions associated to the platform.

(c) that it allows the student to use course documentation for other non-academic matters.

Student's Content

User’s Content

The services allow you to share with EVOLUCIÓN EDUCACIÓN, instructors, or other users, class content, such as assignments, questionnaires, exams, projects and other tasks related to the course curricula, comments made in forums, and “likes” on the platform. Intellectual property rights of the assignments belong to the student, being he or she responsible for the content and opinions. EVOLUCIÓN EDUCACIÓN can use them free of charge for non-commercial purposes, for academic publications or to share in courses, having the only obligation of acknowledging the author.

How EVOLUCIÓN EDUCACIÓN and Others Can Use the User’s Content

The user's academic content grants EVOLUCIÓN EDUCACIÓN with a global, transferable, free of charge, permanent, sub-licensable, non-exclusive to copy, distribute, modify and create derivative works based on public acts and exhibitions, and any other use of the user’s content. This license includes the authorization to EVOLUCIÓN EDUCACIÓN of sub-licensing the user’s content.

Feedback

EVOLUCIÓN EDUCACIÓN is open to suggestions, ideas, comments, or any other feedback related to the Services (“Feedback”), which will be welcome. In that case, the user grants the right without limitations to practice or use it, which in no case will confer the right to financial compensation. Accepting feedback is an exclusive right of EVOLUCIÓN EDUCACIÓN, and in no case should it be interpreted as an imposition.

Security

EVOLUCIÓN EDUCACIÓN has acceptable IT security measures on the platforms; however, if due to any reasons, you doubt your username or information can be violated, inform us immediately to evolucion@conmebol.com. In no case should EVOLUCIÓN EDUCACIÓN be responsible for a leak of information.

Third-Parties’ Content

Through the services, you will have the possibility to access or use the content for academic purposes provided by the instructors, other users, third parties, as well as links to web pages and services maintained by third parties. EVOLUCIÓN EDUCACIÓN cannot guarantee that third-parties’ content, in the Services or any other place, does not contain material that you can find offensive or inappropriate, or malware or other pollutants that can damage your computer, mobile device or any files in them. EVOLUCIÓN EDUCACIÓN rejects any liability or legal obligation related to your access or use of third-parties’ content.

Trademark and Copyright Policy

EVOLUCIÓN EDUCACIÓN respects our users’, participating institutions’, and other third parties’ intellectual property rights, and hopes our users do the same when using the services. EVOLUCIÓN EDUCACIÓN has embraced and implemented the EVOLUCIÓN EDUCACIÓN Copyright and Trademark Policy under the law, including the Digital Millennium Copyright Act.

Educational Research

EVOLUCIÓN EDUCACIÓN commits to advance on learning and education, hence records of your course participation can be used for educational research. For that, the course content can vary, always with the conviction that it will promote a better-quality education. Research results may be globally distributed. Your personal identity, with the exception of cases of express consent, will not be distributed publicly in the results.

Payment Services

EVOLUCIÓN EDUCACIÓN offers payed Services, such as Course Certificates in certain courses, for which a price will be established. Unless otherwise stated, all rates are expressed in American dollars. The student is responsible for paying in due time and form previously established. If your payment method fails or your account has expired, other payment methods can be used. Rates can change based on your location and other factors. EVOLUCIÓN EDUCACIÓN reserves the right to change the rates at any moment on a discretionary basis. Nonetheless, all changes, updates or modifications will be published 15 days in advance, and effective immediately after that period. Reimbursements may be available for payed services, as described in our Reimbursement Policy.

Modifying and Suspending Our Services

As any other platform, we are in constant change, looking to enhance our services, so functions, characteristics or requirements may be added or removed, and a service may also be suspended or cut off completely. In consequence, EVOLUCIÓN EDUCACIÓN, at their sole discretion, can suspend the use of any Service for no reason. If a payed service is suspended, a reimbursement may apply in accordance with the Reimbursement Policy. EVOLUCIÓN EDUCACIÓN, its collaborating institutions and instructors, colleagues, sponsors and other business partners and their employees, their contracting parties, and other agents, in no case should have responsibility with you for that action.

Legal Notices

The services and content included will be provided “as is”, without any kind of guarantee, explicitly or implicitly. EVOLUCIÓN EDUCACIÓN specifically denies any guarantee or condition of merchantability, fitness for a particular purpose and non-infringement, and any guarantee that arises during the course of transactions or the use of the trademark. EVOLUCIÓN EDUCACIÓN does not assume any liability associated with your access or use of services or any related content. You acknowledge and agree that the liability for any access or use of service or content falls on you.

Limitation of Liability

EVOLUCIÓN EDUCACIÓN shall not be liable for indirect, incidental, special, consequential or punitive damages; for any loss of profit or revenue produced directly or indirectly, or for any loss of data, use, goodwill or other intangible losses, resulting from:

(a) your access, use or impossibility to access or use the services;
(b) behaviors or contents from other sources that are not related to EVOLUCIÓN EDUCACIÓN, including without limitation any defamatory, offensive, or illegal conduct; or br> (c) access, use or non-authorized alteration of your content or information.

In no case shall EVOLUCIÓN EDUCACIÓN be completely liable for claims for services that exceed ONE THOUSAND AMERICAN DOLLARS (USD 1,000) or the amount received by EVOLUCIÓN EDUCACIÓN for the provision of services during the last six months, whichever is higher.
The user acknowledges and agrees that the waiver and limitation of liability established in this document show a reasonable and fair distribution of the risk between EVOLUCIÓN EDUCACIÓN and the parties, and that these limitations are the fundamental basis of EVOLUCIÓN EDUCACIÓN ability to make services available inexpensively.

Indemnización

The User agrees to indemnify, defend, and hold harmless EVOLUCIÓN EDUCACIÓN, their employees, teachers and partners from any claims, liability, cost, and damage, including legal expenses, carried out by third parties related to:

(a) the use or attempt to use the Services in a way that violates these Terms;

(b) the violation, by you, of any law or third-parties’ rights; or

(c) User’s Content, including, without limitations, any claim of infringement or misappropriation of intellectual property or other property rights.

Applicable Law and Jurisdiction

The services are managed by CONMEBOL, located in Autopista Silvio Pettirossi and Valois Rivarola, Luque, Paraguay. You agree that any conflict related to this Terms shall be governed by State Laws of Paraguay, except for your conflicts related to legal provisions. You expressly agree to the personal jurisdiction of and the exclusive venue in the Federal and State Courts located and serving in Paraguay, as the legal forum for such matters. Except for claims by injunctive or other equitable relief, for service-related claims, where the total amount requested is less than 100 American dollars (USD 100), both you and EVOLUCIÓN EDUCACIÓN can choose at any time to resolve an appeal, without pity, through binding arbitration. The dispute will be resolved through an established alternative dispute resolution ("ADR") provider, chosen by mutual agreement between you and EVOLUCIÓN EDUCACIÓN. The Parties and ADR provider shall not involve any personal appearance of the parties or witnesses, unless the parties agree the opposite; instead, the arbitration will be conducted, at the option of the party requesting relief, online, by telephone, or in writing. Any judgment pronounced by the arbitrator may be presented in any court with competent jurisdiction.

Overall Terms

Terms Review

EVOLUCIÓN EDUCACIÓN reserves the right to review the Terms at any moment, which will be published and informed to the users effective immediately. After 72 hours of being published on the web, no claim of ignorance may be made about the changes.

Severability; Waiver

Should any provision of this document be held invalid, it shall not affect the rest, and shall continue to be applied and enforced, as may be proper.

Participating Institutions

EVOLUCIÓN EDUCACIÓN participating institutions are third parties’ beneficiaries of the Terms, which are applicable to them.

Acceptable Use Policy

EVOLUCIÓN EDUCACIÓN mission is to transform the way in which today's and future professionals develop their skills. We want our students and instructors feel safe and comfortable when using our Services. EVOLUCIÓN EDUCACIÓN will be able to monitor, delete or edit the content provided by the users, as well as inappropriate activities.

Platforms’ Usage Rules

Prohibitions:

• Sharing illegal content or content that promotes illegal activities.

• Sharing content containing threats or promoting violent acts.

• Sharing content containing indecent actions or discriminatory content.

• Sharing content that violates intellectual property, privacy, or other rights. It is compulsory to cite the source or authors.

• Sending spam to others.

• Sending spam, as well as advertising, promotional content or irrelevant or inappropriate requests.

• Performing acts against local, state, national or international laws, and fail to fulfill any contractual or fiduciary obligations.

• Sharing your password, allowing access to your account to third parties, or performing acts that can jeopardize your account, or accessing third-parties’ accounts.

• Reproducing, transferring, selling, scalping, or inappropriately using the EVOLUCIÓN EDUCACIÓN platform content.

• Accessing, manipulating, or altering the platforms without authorization.

• Bypassing security measures or performing reverse engineering of systems or networks.

• Interfering with any user, host, or network by sending them viruses, overloading, spamming, or bombarding their inbox.

• Using our Services to distribute malware.

• Using a fake ID or documentation, or fake content to distort your EVOLUCIÓN EDUCACIÓN membership.

• Being an accomplice of someone who incurs in any of the above-mentioned activities.

Trademark and Copyright Policy

EVOLUCIÓN EDUCACIÓN respects the collaborating institutions’, instructors’ and third parties’ intellectual property rights, and hopes the users do the same when using the Services.

EVOLUCIÓN EDUCACIÓN reserves the right to suspend, disable, or delete the accounts of users who violate or who are repeatedly accused of violating copyrights, trademarks, or other intellectual property rights.

If you believe that the materials on Services violate your copyright, please submit a request for them to be removed or have their access blocked, with all documentation supporting your alleged right.

Notifications should include:

1. The claim should be signed under the hand, or digital signature (verified) of the owner of the alleged Intellectual Property right. In case you are represented by an attorney, there must be documentation that recognizes them as such.

2. The claim must contain the identification of the copyrighted work claimed to have been violated (or, if there are multiple copyrighted works located on the Services that are covered by a single notification, a representative list of such works).

3. The claimant’s name, address, phone number and e-mail address (if available) should be provided.

EVOLUCIÓN EDUCACIÓN respects third-parties’ trademark rights. Accounts with misleading content or content that violates others’ trademarks may be updated, suspended, disabled, or canceled by EVOLUCIÓN EDUCACIÓN at their sole discretion.

EVOLUCIÓN EDUCACIÓN Reimbursement Policy

In the event of being suspected of violating the EVOLUCIÓN EDUCACIÓN Honor System or the Terms of Use, you will have no right of reimbursement or compensation for the payed courses.

In case you do not pass a course or specialized program, or get a failed grade, you will not have the right of reimbursement or compensation either.

Honor System

All students who participate in an Evolución Educación program must agree and abide by the following code of behavior:

1. Each person shall register with one account alone.

2. I commit to doing the assignments, questionnaires, and exams on my own, except for those tasks that expressly allow third-party collaboration.

3. In no case should I provide solutions to the assignments, questionnaires, exams, projects, and other tasks to third parties, unless it is specifically allowed.

4. In no case shall I plagiarize, copy assignments, or get involved in activities that dishonestly improve my results, or dishonestly improve or affect others’ results.

Privacy Policy

The “Legal Notice” that regulates the service usage of the website https://evolucion.conmebol.com and that EVOLUCIÓN EDUCACIÓN makes available for Internet users, will be fully applicable and is deemed to be reproduced.

1. Purpose of the information:

   • Personal information required will be used to provide the user with information about degree courses, courses and requested programs, as well as other activities related to EVOLUCIÓN EDUCACIÓN.

   • The data being processed will not be used for purposes other than or incompatible with those for which they were obtained, and it will be used solely by Capabilia S.A. for EVOLUCIÓN EDUCACIÓN.

Agreement to the Terms and Conditions

By providing their personal information, the Users allow EVOLUCIÓN EDUCACIÓN to present them with information of their interest, including advertisement and information on their programs, courses, and extended activities, by any means. In case you do not wish to receive it, please e-mail info@capabilia.org.

The user grants informed consent about:

• The existence of a data base: the data collected by the corresponding forms will be incorporated to a data base belonging to EVOLUCIÓN EDUCACIÓN.

• Users will have the right to unsubscribe from the data base. In case the Users do not wish to be contacted for these purposes, they can irrevocably notify EVOLUCIÓN EDUCACIÓN, and they will proceed to interrupt this type of communication as soon as possible.

Data Security

EVOLUCIÓN EDUCACIÓN complies with personal data protection legally required, in accordance with the regulations of the Republic of Paraguay and implements means and technical measures of protection.

However, the User must be aware of the fact that the security measures on the Internet are not unbreakable and there is a risk, which is accepted by them.

EVOLUCIÓN EDUCACIÓN excludes, to the fullest allowed by law, any liability for damages of any kind that may occur. In all aspects, the “Legal Notice” that regulates the service usage of the website https://evolucion.conmebol.com and that EVOLUCIÓN EDUCACIÓN makes available for Internet users will be applicable.
